Hi! I am after all the legal documents I need for my website including:
Terms and Conditions
(and anything else you feel I might need or is missing)
The site works in the following fashion:
Subscribers of "sellmydocs" can create their own store within my site, allowing them to upload and sell their own documents (like design schematics, presentations, etc). Other subscribers can then buy the document and download it to use it as a template for their own work, etc. Subscribers pay a fee of $2.99 a month (subject to change) for hosting their own store on my site..
A preview of each document will also be available. I want a clause about not stealing information from preview documents, etc.
Its no different to how ebay works really, except the items are a fixed price (set by user), not auction, and I don't charge to place an item on the site, only a monthly subscription fee. The main difference is the copyright thing. Uploader must take full impressibility for content they are uploading. I am merely the service in the middle
I also need the following accounted for in the terms:
As the owner/provider of an online platform to sell documents, you have every right to remove - temporarily or permanently - any document offered for sale on the site.
Can you make sure I have clauses that protect me from obviously being included in copyright issues, but also third party stuff? As an example (crude but works) If a member uploads a photo of his family, then gets a divorce, and the wife did not approve the upload of her face onto the site, I don't want to be liable, etc. I just need to really make sure the copyright stuff is covered. Last thing I need is a lawsuit from an individual or company for hosting copyright materials or participating in distribution, profiting, etc.
I also want to own the rights to these documents when they are done so I can do with them as I please.
Sound like something you can help with? I would like you to start asap as the last freelancer bailed on me after giving him two weeks to come up with something. Very disappointing!
