Contest Brief

I need help formulating the legal language that makes good argument for a new water service into an existing building. Currently the main water supply and shut off is accessed through a privately owned tenant space that is not owned or under the control of my client. In the event that the water needs to be shut off and restored again by any one of the condo owners in the building (including my client), they need to ask for permission to enter into a space that is normally unoccupied, locked and inaccessible. While it is the policy of Public Works to provide only one water meter and one water entrance into a single address (one real property), I need to provide a good argument to the City that will allow for an exception or variance. If a new water tap can be made into the City Sewer (along with new water meter and back flow preventer), then my client can quickly shut off the water to make modifications in his restaurant and then turn it back on without having to request permission and wait for a response. As I am not thoroughly versed in the language related to condominiums, I am asking for help.

The project is located in Omaha Nebraska

Hey CH, I can provide you the legal sections under which your problem can be solved easily. As it is under separate Act in Omaha ,You have to act and apply according to prescribed laws. For detail you can come to the private chat for further clarification. Thank You!

Let's assume the public works receive the letter. From their point of view, in lack of access to the main shut off valve in the building, they can only do work if they shut off a valve or pump on a street or district level. This implies higher costs for the condo Association and probably longer waiting times, as repairs on this level (streets, districts being affected) have to fit in the busy schedule of the public works in a large city such as Omaha. Based on the previous arguments, they first reply would probably be a recommendation to gain access (permission to one time access) to the current space which contains the main supply and shut off valve, so they can seal them and install the new water meter, shut off valve and back flow prevent valve on a publicly accesible place in the building.

In my understanding, the bigger issue here lies not in the form of the request, but in the fact that currently the main shut off valve is inaccessible. Should the city water works grant your request, they would still have to shut off the flow first, i.e. they would be in the same situation as your client who owns a restaurant. I would gladly help with formulating the legal language for this request, but there are missing details that should be addressed. Please reply or contact me if you wish to discuss further possibilities. Thank you.
