StarfishMusic (SFM) is a music website that where users can post music (whether it be their own original content or music they want to share from other media sites such as YouTube and/or SoundCloud, etc) as well as purchase and sell original music.
The currency at SFM is "credit points". 100 credit points is equivalent to $1 USD.
When people first register an account at SFM, they are labelled as "music lovers" initially, and are awarded with 100 credit points. Users can buy more credit points in order to purchase the downloads of the digital content from the SFM website. Payment to SFM for the purchase of credit points is made only through PayPal. (Starfishmusic does not hold any credit card details, only users' username and password).
If users do not wish to purchase any music in the beginning, they can post/share new music and/or simply complete SFM 'missions' in order to gain "experience points".
For example, the first mission new users are given is to listen to any song posted on the website for at least 1 minute. As soon as they have completed this "mission", they will be awarded by 100 experience points. Once users have some experience points in their account, they can begin to 'heart' music that they like.
For users who have posted music, the more 'hearts' they get for the music they have posted, the more "experience points" they gain.
At the same time, if a user has "hearted" a particular song, which will cost experience points initially, and many people then "heart" that song, that user will be rewarded with more experience points. (A way to look at it is that if you've made a good investment, you will be rewarded with a better return).
When users reach certain levels of experience points, they 'level up'. The higher the level, the more times you are able to 'heart' the same song (the more you are able to invest). At the same time, leveling up awards the user with more credit points in their SFM account.
Once users reach level 5, they will have unlocked the ability to sell music. They can do this by creating a "Persona Account", which will function as their artist account, through which they can sell their music. Only original content by the musician may be sold through the website. Musicians are held responsible for ensuring they have the ownership rights for whatever original content they are selling on the website.
Users who are not musicians can simply 'pass' the option to create a Persona Account, and remain as "music lovers".
With every single digital content sold on SFM (each song will be $1 USD), the artist will receive 87.5% of the very first sale of that song, and then 43.5% of subsequent sales of that same song thereafter, and SFM will receive 12.5%. The remaining [url removed, login to view]% of subsequent sales of that same song will be shared among those you purchase the music. This is the innovative feature of SFM - profit sharing! The same investment structure as with experience points applies when music lovers purchase digital content on the website using credit points.
For example, if musicloverA was the very first person to purchase a song by JoPop, JoPop will receive 87.5% of the sale income and SFM will receive 12.5%.
- If musicloverB were to then purchase that same song by JoPop, JoPop will receive [url removed, login to view]% of that sale, SFM will receive 12.5%, and musicloverA will receive [url removed, login to view]%.
- If musicloverC then purchases that song, JoPop will receive [url removed, login to view]%, SFM will receive 12.5% and the remaining [url removed, login to view]% will be shared between musicloverA ([url removed, login to view]%) and musicloverB ([url removed, login to view]%). And so on....
For every artist who sells their music through a "Persona Account", the first 2500 credit points they earn (not per song, just in general) will go to SFM. All income they receive past that amount goes straight to them in accordance with the percentage structure outlined above.
We are seeking a legal professional to assist in writing up the Terms and Conditions of the site.
