Brand name and trademark work (involving research or your creativity)

Looking for a brand name specialist to give a professional opinion for our peace of mind. This could be a simple no brainer that takes 10 mins for someone experienced, or it could involve much searching in relevant trademark regulations to find the answer. Of course, we'd prefer if you were the former. Needs to be well versed (or competently research supporting evidence) regarding trademark rights across USA, Canada, Singapore and potentially other Asian markets. All of this info is readily available online. It's a bonus if you have experience with product branding for consumer goods, specifically natural health supplements, vitamins, etc. There may be follow up work for other business related issues if we find that you gel with us well!


This project is hard to describe as we are ultimately looking for a opinion, or at most a research-based effort to support the decision we are about to make BEFORE we go ahead and register a new trademark. We are a new company looking to launch our first new brand of natural health supplements across global markets. We've thought of a brand name that we would like to use, but found an existing exact match for another product name in similar industry. It is already trademarked in USA & Canada by an internationally active competitor. We have plans to register our trademark in Singapore, for which the name is still available. However, this competitor is much larger than us, established in the market and therefore may enter the Singapore market or other Asian territories which will form a basis for dispute in the long term. Hence our intention is to create a differentiated name that will meet international standards for a distinctive mark, enough to distinguish it safely for trademark registration as well as avoidance of future dispute. The name in question involves general concepts of "Nature", which is a word and name commonly used in competing brands across many products in the health supplement industry. Ours is a pill form of natural supplements whereas this competitor's product is a liquid form.


We would still like to use the name and similar concept, so we have also thought of a few alternatives as well as ranked them in priority preference for our unique situation. These involve adding new words or changing spellings to modify. We will share all these name ideas with you, and provide other details of the situation in order for you to help us. We just need verification that any or all of these alternatives would not cause any trademark violations or relevant business/marketing issues in future. We would even welcome any creative new suggestions you might come up with, but this would not be required, you can just work with the names we have come up with.

YOUR DELIVERABLE, using our tentatively picked names as starting ideas:

#1: confirmed opinion, backed by quoted research from official sources (ie. a government site or legal blog, etc would be better than just a forum post)

#2: examples of other cases/precedents that may support your opinion (this may be optional, in case #1 is not sufficiently solid enough)

You are working in a consultant capacity, not a legal capacity, although the subject matter may at times broach legal terms. Your opinion is one of evidence-based conclusion, and will not constitute a legal opinion, so we will not hold you liable for any future circumstances. We are just trying to get a fresh perspective from our many many conversations around this (to the point of fatigue!).

You will have access to one of the company's owners during this project, so that your work can be facilitated by any necessary interaction to ensure responses to any issues or questions you may have. For an unstructured project such as this, we believe that good communications will be essential to success!
