Topic: Writer's choice
1. Describe a piece of legislation, a case, or a body of case law related to information privacy law (hereinafter the "Law"). It does not have to be a law that we discussed in class.
2. Identify and discuss the privacy interest(s) that the Law seeks to protect. Consider the privacy theories that we have discussed in class (Public v. Private sphere, right to be let alone, secrecy, control over information, limited access to the self, pragmatic approach, contextual integrity). If you choose to apply only one or some of the privacy theories, you need to explain why you reject the other theories. Consider whether the Law was introduced in response to a societal change that compromised privacy. Was it perhaps triggered by a particular incident? You should also discuss whether the privacy interest(s) that you identify is/are still relevant today. Does the Law still adequately protect it/them? If you discuss a piece of legislation, you may need to consult its legislative history.
3. Discuss how the Law affects other interests. As much as possible, try to explain how it affects current and future technologies. How should these other interests be balanced against the privacy interest(s) that the Law seeks to protect?
