You are working as a judge’s associate in the New South Wales Supreme Court. Your judge is particularly interested in the law of Equity, having previously sat on a number of prominent Equity cases.
Your judge has asked you to write a report on trends in recent case law in Equity. In particular, your judge wants you to consider:
• whether Equity is responding adequately to society’s modern needs; and
• whether judges should be steering the law in any particular direction and, if so, how this direction differs from current developments.
Your report should focus on ONE AREA of the law of Equity covered in the subject outline. [note - my selected topic is benefits of setting up trust structures in relation to asset protection , tax minimisation , succession planning etc]
As a judge’s associate, you are expected to demonstrate and possess strong legal research and writing skills. As a result, it is expected that you will undertake research beyond the course materials in completing this assignment. Your report should draw on recent, relevant case law and academic commentary.
