I need some case precedents and journal articles on the following question;
Today, would it be acceptable for one party to imprison another party in order to force compliance with a contract?
Using the decisions in "Balmain New Ferry v Robertson" and "Herd v Weardale" are these decisions applicable if a similar case where to be heard today?
I belive it is still applicable, but require some case precedents and journal articles to back this. I have found one recent case "Halici v KDR Victoria Pty Ltd t/a Yarra Trams (No. 2)" that states that an employer can imprison an employee in certain circumstances. I would like to run with this and find other case law and journal articles to back this up.
