I am wanting a second opinion on some advice I have been given by a few people.
I sold a vehicle on eBay as an auction listing. Unfortunately, the gentleman took the vehicle away and it supposedly broke down on the way home. He has signed a declaration form to say that the vehicle is sold as seen, tried tested and approved without warranty, and no returns. It also says no returns on the eBay listing.
His Wife actually bid on the vehicle using her eBay account, but he came to collect and signed the documents. The money was sent VIA his Finance company.
He has said that he has lost all of the vehicle documents already, or says he cannot find them.
He is threatening legal action if I do not put money towards the repairs of the vehicle or if I do not buy the vehicle back.
He got roughly 25 Miles from the Location that I sold it from, filled up with Diesel and it came to a halt on the side of the road 10 Minutes Later
The breakdown recovery actually said it was an electrical issue, but the gentleman has taken it to a garage who have said it is a new engine job and want in the region of £4,500.00.
I am wanting legal advice with where I stand and if I actually have any legal obligation to pay anything back as it is sold at auction, and the declaration above is signed.
I actually have phone conversations recorded where he says that he Feels that I have sold the vehicle in good faith and that I wouldn't have known the problem.
