“The employer (wvkeith) originally alleged work was not complete. The worker (Vastal I-Tech) originally alleged that it was complete. vWorker determined that it was not complete but that time remained to complete the work as the project was in implicit extension and both parties were to work together. However, Vastal I-Tech then claimed they would not do a Flash portion of the job becuase it was not part of the contract. Wvkeith alleged it was. vWorker determined that the contract could be considered vague if a person ONLY read 1 of the 3 documents in it (which Ankur alleged was the case, becuase he believed only was relevant). But even if so, he still is found negligent for not inquiring further on the vague requirement and just assuming what he should do. Had he read all documents it would not have been vague, or had he inquired further he would have found out the correct answer. He was warned that this is not the proper way to manage the requirements. Vastal I-Tech refused to accept responsibillity for the mistake and stalled progress for a signifcant # of weeks. This at-fault behavior caused them to forfeit the protection of implicit extension. As the work was not complete, all funds were returned to wvkeith.”tkeith Apr 1, 2005.
