Terms & Conditions Form Validation

I've got a simple form validation on this page that I want to ensure that users HAVE to check the Terms & Conditions box before redirecting them to the paypal payment.

You will need to visit [login to view URL] and click on any of the BUY NOW buttons.

That will take you to this page [login to view URL]

Here you will see that once you click on the picture and then go to complete the payment.

If you don't click the T&C's box the Error Message pops up saying "Please check the Terms & Conditions box" but as soon as you close that down the form submits and the page is redirected to paypal.

Again the user HAS to check the T&Cs box BEFORE going to paypal to make the payment.
